Ownership; License; Restrictions
This is v1.0 of the license associated with Scarce Editions acquired on Zien. An update to enable full custody of non-fungible tokens (“NFTs”) is expected by Jan 31st 2021.
a. Each Scarce Edition is a .zip file containing pre-fabricated artwork materials and instructions hashed and saved with a non-fungible token (NFT) on the Ethereum blockchain. By owning a Scarce Edition, you own the underlying NFT via a custodial wallet held by Zien X Ltd on your behalf. At no point will we modify the ownership of any Scarce Edition, unless or until you request transfer of it to an Ethereum wallet you specify (if and/or when this feature is enabled).
b. Permission is granted to download one copy of the materials associated with a Scarce Edition and to produce one copy of the artwork for yourself. Under this license you may not:modify or copy the materials; attempt to decompile or reverse engineer any software contained with the materials; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person. This license shall automatically terminate if you violate any of these restrictions.
c. You understand and agree that a Scarce Edition you acquire is yours to keep and enjoy, but it does not give you any rights or licenses in or to the artwork (including, without limitation, the copyright in and to the art and drawings associated with it) other than those expressly contained in these Terms; and (ii) that you do not have the right to reproduce, distribute, or otherwise commercialize any elements of the artwork (including, without limitation, the creator’s copyright in and to the art and drawings associated with it) in any way without the creator’s prior written consent in each case, which consent the creator may hold in their sole and absolute discretion.
Modification of License and Transfer
This License may be discretionarily modified or replaced at any time. The most current version of this License will be appended to NFTs on the Ethereum blockchain with the “Last Revised” date at the top of the License changed. Any changes or modifications will be effective immediately upon appending revisions to NFTs. You shall be responsible for reviewing and becoming familiar with any such modifications. You waive any right you may have to receive specific notice of such changes or modifications. Use of the Service or transfer of Scarce Editions by you after any modification to the License constitutes your acceptance of the License as modified.
We may make changes to this License from time to time. When we make changes, we will make the updated License by appending it to NFTs and update the “Last Updated” date at the end of this License accordingly. Any changes to the License will apply on the date that they are made, and your continued access to or use of the Service after the License has been updated will constitute your binding acceptance of the updates.
Disclaimer The materials contained on the Service are provided on an 'as is' basis. Zien X Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Zien X Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Service or otherwise relating to such materials or on any sites linked to them.
Limitations In no event shall Zien X Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Service, even if Zien X Ltd or a Zien X Ltd authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Accuracy of materials The materials appearing on the Service could include technical, typographical, or photographic errors. Zien X Ltd does not warrant that any of the materials on the Service are accurate, complete or current. Zien X Ltd may make changes to the materials contained on the Service at any time without notice. However Zien X Ltd does not make any commitment to update the materials.
Links Zien X Ltd has not reviewed all of the sites linked to its Services and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Zien X Ltd of the site. Use of any such linked website is at the user's own risk.
