THE TERMS AND CONDITIONS OF USE ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED IN SECTION 14.
Section 1: The Agreement
1.1. The website (the "Site") and any products and services (collectively, the "Services") offered by Rodeo Money, Inc., ("Rodeo", "we", "us", or "our") are delivered subject to the terms set forth in these Terms and Conditions of Use ("the Agreement"). You ("you," "Your," "your") acknowledge that the Services are the property of Rodeo and in using the Services, you hereby agree to be bound by the Agreement.
1.2 On the date you access and use the Services, or click a button or checkbox to accept or agree to the Agreement where that option is made available, or complete an order form to engage the Services (the "Effective Date"), you agree to (1) be bound by the Agreement, and (2) consent to the collection, use, disclosure, and other handling of information as described in our Privacy Policy. if you do not agree to the terms (1) and (2), please do not access the Site or use the Services.
1.3 Rodeo offers the Services to you based on your acceptance of the Agreement without modification. Rodeo reserves the right and may, from time to time, make changes to the Services or to the Agreement. See Section 4: Changes to the Agreement or the Services.
1.4 You represent to us that you and your financial institutions, or any party that owns or controls you or your financial institutions, are (1) not subject to sanctions or otherwise designated on any list of prohibited or restricted parties, including but not limited to the lists maintained by the United Nations Security Council, the U.S. Government (e.g., the Specially Designated Nationals List and Foreign Sanctions Evaders List of the U.S. Department of Treasury and the Entity List of the U.S. Department of Commerce), the European Union or its Member States, or other applicable government authority and (2) not located in any country to which the United States has embargoed goods or has otherwise applied any sanctions.
1.5 You represent to us that you are an adult who is at least 18 years of age. Rodeo does not intend to market, or sell the Services or any related services to children. We do not knowingly gather or solicit data from children through the Services.
1.6 Account deletion - to delete an account, please email [email protected], and we will manually review and transfer the assets. We require:
Section 2: Content, Proprietary Rights, and Third-Party Content
2.1 Content. All text, graphics, user interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, the "Services Content"), including design, structure, selection, coordination, expression, "look and feel" and arrangement of such content contained in the Services is owned, controlled, or licensed by or to Rodeo and is protected by applicable U.S. and foreign copyright, patent, and trademark laws, including various other intellectual property rights and unfair competition laws. Certain other words and symbols used to identify the source of third-party goods and services are trademarks of their respective owners. Display of any such trademarks or service marks contained in the Services do not imply that a license of any kind has been granted.
2.2 Use of the Services Content. Except as expressly provided in the Agreement, no part of the Services or the Services Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without our prior written consent or license. Any unauthorized use, downloading, re-transmission, display, distribution or other copying, or modification of any copyrightable matter in the above and/or the Services Content is strictly prohibited, and may result in legal action against those engaging in such activities.
