Welcome to Rally! This Privacy Policy (“Policy”) explains how Vert Networks, Inc., (“Rally” or “we”) collects and uses of Personal Information (defined and explained below) of users (“you”) through our website (letsrally.io) and all related mobile applications (including phone, tablet, and other applications), websites, networks, embeddable widgets, downloadable software, and other services provided by us (collectively, the “Services”).

WHAT IS PERSONAL INFORMATION

Personal Information” means any information relating to an identified or identifiable natural person (an individual, as opposed to an organization). An identifiable natural person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of individual.

WHAT PERSONAL INFORMATION DO WE COLLECT?

Our collection and use of Personal Information are fairly limited and straightforward. If you contact us through our website, we will receive and collect, your name, whatever email address or other contact information you provide, and whatever information you send to us.

If you download our app and create a user account, we will collect the following categories of information: first and last name; username that you select; email address; gender; the date you join; details about your motorcycle(s); links to social media accounts you provide; information about destinations you visit, including images and posts, that you choose to share; membership status in other clubs that you share; your attendance at rallies through our app; your connections to other users of our app; in-app messaging; and app usage. When you are using the app, unless you revise your settings, we will collect your location data to deliver localized content.

For some events, we may ask you to provide your date of birth to confirm participation eligibility.

Further, for some events, you may be required to pay a registration fee. Registration fee payments har handled directly through Stripe – we do not collect payment information or process payments – and any information provided as part of such payments is subject to Stripe’s privacy policy available here.

HOW DO WE USE YOUR PERSONAL INFORMATION? WHO DO WE SHARE IT WITH?

We use your Personal Information in only a few limited ways. We use your name, username, and email address to maintain your account and to communicate with you about your account and user experience if necessary. If there is a minimum age requirement for an event, the registration function in the app may be configured to allow registration only for of-age participants.

We do not share your information with anyone else. We do not sell your information to anyone.

Of course, that does not mean that others will not have access to information about you through our app. Our app is platform to build community among riders and connect riders with club leads, participating brands, and other groups. When you register for events through our app, post comments, images, or videos, follow a group or brand, or otherwise interact with other members of the Rally community, the information that you provide will be available to other participants on our platform.

Although we do not share your Personal Information with anyone else as a matter of course, we might have to do so in the future in certain circumstances, including:

Regulatory Bodies, Public Authorities, and Law Enforcement. We may access and disclose your Personal Information to regulatory bodies if we have a good-faith belief that doing so is required under applicable law or regulation. This may include submitting Personal Information required by tax authorities. We may disclose your Personal Information in response to lawful requests by public authorities or law enforcement, including to meet national security or law enforcement requirements. If we are going to release your Personal Information in this instance, our policy is to provide you with notice unless we are prohibited from doing so by law or court order.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your Personal Information may be transferred as part of such a transaction as permitted by law and/or contract. If such an event occurs, we will endeavor to direct the transferee to use Personal Information in a manner that is consistent with the Privacy Policy in effect at the time such Personal Information was collected.

Other Disclosures. We may also disclose your Personal Information to exercise or defend legal rights; to take precautions against liability; to protect the rights, property, or safety of the Services, of any individuals, or of the general public; to maintain and protect the security and integrity of our services or infrastructure; to protect ourselves and our services from fraudulent, abusive, or unlawful uses; or to investigate and defend ourselves against third-party claims or allegations. Disclosures may be made to courts of law, attorneys and law enforcement, or other relevant third parties in order to meet these purposes.

Please note: We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling, and other similar purposes. For example, we might tell industry partners how many users registered for a particular ride, but we would not disclose identifying information about individual users.

In addition, our Services may contain links to other websites not controlled by us, and these other websites may reference or link to our Services; we encourage you to read the privacy policies applicable to these other websites.
