LAIVE(“we”, “us”, “our”, “ours”, “ourselves”, or “Company”) legally processes and securely manages personal information in accordance with Korean Personal Information Protection Act and other Relevant Laws. This is done to safeguard the freedoms and rights of our Service users. To inform Users about how their personal information is processed, and the standards applied, and to facilitate the swift resolution of any concerns, we have formulated and made public this LAIVE Privacy Policy (“Privacy Policy”). Any revisions to the Privacy Policy will be communicated through website notifications or individual notices.
Compliance with General Data Protection Regulation (GDPR) and Other Regulations: We are committed to complying with the GDPR for our users in the European Union, and similarly with other data protection laws and regulations applicable to our users in different jurisdictions worldwide.
Any capitalized terms used but not defined herein, shall have the meaning ascribed under LAIVE Terms of Service, terms of service for individual Services, or Relevant Laws. If nowhere defined, it shall take on the generally accepted meaning.
Article 1. (Purpose for Processing Personal Information)
We process personal information for the following purposes:
- Member Management
- For Member registration and management (e.g., User verification)
- Provision and Improvement of Services
- For provision of Services such as creating, editing, and listening to A.I. Music;
- For analysis and understanding of User behavior, as well as improvement of Services (including User-interface environment and Service quality);
- For provision, analysis, management, improvements, and personalization of Services and our marketing activities;
- For demographic analysis, Service access and usage record analysis, statistical processing for Service improvement, provision of customized Services, and placement of advertisements;
- For determination of User’s approximate geographic location (e.g., city, state, zip code); and
- For identification of User’s internet service provider(“ISP”) in order to solve any network issues experienced by the User (we may use ISP aggregate information for operational and business purposes as well).
- For verification of the usage methods and sources of utilization for Music created by Users.
- Provision of Safe Services
- For establishing Service usage environment where Users could feel safe and secure in terms of security, privacy, and safety when using Services;
- For prevention, detection, and/or investigation of activities likely to break the law or be prohibited, such as fraud, and for implementation of LAIVE Terms of Service, LAIVE License Guidelines(laive.io/license), and this Privacy Policy (collectively, “LAIVE Terms”); and
- For imposition of sanctions or prevention of activities that disrupt smooth operation of Services, including unjust use of Services and Account theft.
- User Support and Communication
- For User protection and Service operation, such as delivering notices, keeping record of dispute resolution, and processing User complaints;
- For provision of swift and efficient responses to inquiries and requests; and
- For communication with Users regarding Services (e.g., delivering to Users LAIVE-related announcements, detailed information about new features and updates available on LAIVE, and User surveys) and for provision of assistance to Users with regard to any operation-related inquiries or requests. Communication with Users hereunder may take place through various means of communication including e-mail, push notifications, text messages, and online messaging channels.
Article 2. (Usage and Retention Period)
It is our standard practice to delete User's personal information during business hours upon membership cancellation or fulfillment of the purpose for processing the information; provided, however, that upon separate consent of the User regarding retention period, or under statutory obligation, we will retain personal information for the applicable retention period in a secure manner.
- In the following cases, personal information will be retained for a specified duration under User consent:
- Personal information included within User inquiries: retained for 18months from the date of receiving the inquiry.
- To prevent unauthorized use of personal information: Retained for 18months after termination of service use agreement.
- In the following cases, personal information will be retained until the end of each respective time period:
- Pursuant to Act on the Consumer Protection in Electronic Commerce and Enforcement Decree thereof:
- Records related to cancellation of contracts or subscriptions: 5 years
- Records related to resolution of consumer complaints or disputes: 3 years
- Records on Labeling and Advertising: 6 months
- Protection of Communications Secrets Act
- Computer communications, internet log records, and data on tracing access location: 3 months
- Date of telecommunications by subscribers, time when the telecommunications commence and end, subscriber number of the other party, frequency of use, location tracing data of outgoing base station: 12 months (notwithstanding, if data is related to intercity and local telephone service, 6 months).
- Electronic Financial Transactions Act
- Records related to electronic financial transactions: 5 years
