1. Definitions

  1. These terms and conditions (the "Terms") govern the agreement ( the “agreement”) between RSTMH and Manta Ray Media Ltd. (the "Partners") and the organisation “Organisation” for the use of the following services on the website located at: https://www.growglobal.health/ (the "Website"):

    each as defined below. The Opportunities Service and the Advertising Service shall each be a Service and collectively known as the "Services". These Terms shall apply to all of the Services except for where they are expressly stated to apply to one Service only. This agreement applies to Organisations using the Services and also to the Contributors that use the Website and the Services on behalf of the Organisation. By using the Services the Organisation and the Contributors agree to be bound by these terms and conditions.

2. The Opportunities Service

  1. The opportunities service (the "Opportunities Service") is the service provided by the Partners which allows Organisations (or the recruitment agency for such organisations) to place and access their opportunities on, and to self-upload information about the opportunities to, the Website.
  2. Opportunities ("Opportunities") for the Website are accepted subject to these Terms.

3. The Advertising Service

  1. The advertising service (the "Advertising Service") is the service provided by the Partners which allows Organisations (or advertising agency for such organisation) to place and access their advertisements on, and to self-upload advertisements to, the Website.
  2. Advertisements ("Advertisements") for inclusion on the Website are accepted subject to these Terms.

4. Access to the Services

The Partners allow the Contributor and Organisation to access each of the Services on the basis that:

  1. the Contributor represent an established Organisation genuinely looking to fill an opportunity in global health, being either an Organisation working in or with an interest in global health, or a recruitment agent acting for an Organisation;
  2. the Contributors password is personal to them and may not be disclosed to any third party to access any of the Services or otherwise shared with or used by any third party. If the Contributor becomes aware that any third party has access to their password, they will immediately notify the Partners and the Partners shall provide them with a new password as soon as reasonably practicable. The Contributors shall at all times ensure that their password is safe and secure;
  3. the Contributor will not do anything which would assist anyone who is not a registered user of the Services to gain access to or misuse it;
  4. the Contributor will not create additional accounts for the purpose of abusing the functionality of the Website, or other users nor will the Contributor seek to act as another user;
  5. if, for any reason, we believe that the Contributor has not complied with these Terms or are abusing the Services in any way, the Partners may, at its discretion, cancel, suspend or otherwise restrict the Organisations access to the Services immediately and without giving any advance notice.

5. Contributors Use of the Services

The Contributor hereby warrants, represents and undertake to the Partners that:

  1. They will only use the Services and any information they receive under the Services for their recruitment related activities;
  2. Their use of the Services will not be prejudicial to the image or reputation of the Partners, the Website or any other recruiters who use the Website;
  3. In relation to obtaining, storing and using any personal data derived from their use of the Services or otherwise in connection with their use of the Services that they are acting as a data controller in their own right and they have complied and will comply with the all applicable laws relating to data protection and privacy including (without limitation) the EU General Data Protection Regulation (2016/679), the Data Protection Act 2018, the EU Privacy and Electronic Communications Directive 2002/58/EC as implemented in each jurisdiction, and any amending or replacement or equivalent legislation from time to time as well as any guidance issued by the Information Commissioner; and
