These Terms and Conditions (the Agreement) are a legally binding contract between you and Undefied (Undefied, we, or us), and govern your use of the Headsup landing page at https://headsup.site (the Website), the Headsup web application at [https://headsup.app](https://headsup.app,) (the Application), and the Headsup Chrome extension (the Extension) (collectively, Headsup, or the Services).
By using any part of the Services, you agree to become bound by the Terms and Conditions in this Agreement. If you disagree with any part of this Agreement, you may not use any part of the Services.
We reserve the right to modify or replace the Terms and Conditions in this Agreement at any time. By using any part of the Services after revisions become effective, you agree to become bound by the revised Terms. If you do not agree to the new Terms and Conditions, you may no longer use any part of the Services.
The Services may not be used for activities prohibited by applicable laws. We can not be held responsible for your use of the Services in a way that breaks the law. We retain the right to review whether your use of the Services takes place, or has taken place, in accordance with this Agreement.
Ownership of any part of the software that makes up the Services shall remain with Undefied. This Agreement does not transfer to you any intellectual property owned by Undefied. Undefied, Headsup, the Headsup logo, and all other trademarks and graphics used in connection with the Services are trademarks of Undefied.
You own the data that make up the tests that you create using the Services. You have the right to interact with this data in the ways made possible by the Services. We reserve the right to change the ways that the Services let you interact with your data.
This Agreement grants us permission to add the e-mail address tied to your account to our mailing list. We promise not to spam you, and we shall not share your e-mail address with third parties, nor shall we use your e-mail address for purposes not related to the Services. You may unsubscribe at any time by following the instructions at the bottom of each e-mail.
We reserve the right to terminate gratuitous Services at any time, for any reason, and without prior notice.
THE SERVICES ARE PROVIDED "AS IS", WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW WE EXCLUDE AND DISCLAIM LIABILITY FOR ANY LOSSES AND EXPENSES OF ANY KIND AS THE RESULT OF THE USE OF THE SERVICES.
This Agreement shall be governed by and interpreted in accordance with the laws of the Netherlands. Disputes are to be submitted to the Noord-Holland District Court.
