Effective: April 01, 2021

By using the GetFrank, PBC (“Frank”) website or services (the “Services”) you are entering into a contract with Frank based on these Terms of Use, the Privacy Policy and any applicable Community Guidelines (collectively, the “Agreement”). If you violate the Agreement, we may block or deny you access to the Services, remove offending content, or pursue and hold liable to the fullest extent of the law.

Frank and you agree to the following:

1. Basics

A. You are responsible for your use of the Services.

B. You cannot use the Services if you are under 16 years of age or your use would violate any law. If you are over 16 and under 18 years of age you may only use the Services under the direct guidance and supervision of a parent or guardian.

C. Only workers employed by a US employer may use the Services.

D. We may change the form, features, storage, nature or availability of the Services at any time without liability to you.

E. We may include advertisements on the Services.

F. You are responsible for any activities on your account. You may not share your password and agree to change your password immediately if your password or account has been compromised.

G. We are not responsible for any consequences that result from your use of the Services, including any negative employment consequence.

H. You are responsible for complying with all applicable laws when using the Services.

2. Prohibited Users

A. You may not use the Services if you are a manager, supervisor or in the human resources or legal departments at your organization, or acting as a representative for those functions.

B. You understand that Section 8 of the National Labor Relations Act makes it an unfair labor practice to interfere with, restrain, or coerce employees in the exercise of Section 7 of the Act (the right to self-organization, to form, join or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection). Please be aware that misrepresenting your identity while using the Services for the purpose of gaining entry or interfering with exercising Sections 7 and 8 is also considered a violation of federal labor law. We will pursue prosecution of any violation of this term to the fullest extent of the law.

If you violate this Section, in addition to Frank’s other remedies available at law, you agree to pay Frank liquidated damages in the amount of: (i) $25,000.00 for creating an account; (ii) $25,000.00 for any post, comment or other content you upload to the Services or download from the Services; (iii) $25,000.00 for each profile or campaign you view; and (iv) $1,000.00 for each day you have an active profile.
