August 2020: the Ministry of Culture sent a questionnaire to selected stakeholders asking for feedback on the implementation of the DSM Directive, with a view to conduct a public consultation on the implementation in October 2020.
September and October 2020: the Ministry of Culture extended the opportunity to send responses to the questionnaire to other stakeholders.
2020-10-15: Deadline set by the Ministry of Culture to Communia to submit a response to the questionnaire.
2021-09-23: Council of Ministers approves law proposal to implement the DSM Directive.
2021-09-28: Implementation proposal is sent to the Parliament by the Government, with a recommendation to hold a public consultation during the Parliamentary procedure.
2021-09-29: Implementation proposal is sent to the Commission of Culture and Communication.
2021-10-19: Commission of Culture and Communication issues an Opinion on the implementation proposal. The Opinion deals mostly with formality requirements and recommends a consultation to certain entities (mostly rightholders, but also the Portuguese Consumers Organization DECO and the digital rights organization D3).
2021-10-22: Public consultation started. Submissions should be sent to [email protected]
2021-11-21: Deadline for submissions.
2021-12-05: Parliament dissolved. The legislative procedure expires.
2022-11-24: Council of Ministers approves proposal to implement the DSM Directive, by means of a delegation law.
2022-11-28: Government sends to the Parliament proposal to obtain authorization to implement the DSM Directive, further requesting priority and urgency in the legislative procedure. The draft implementation decree is attached to the authorization request. In the proposal the government says that it will hold a public consultation.
2022-11-29: Implementation proposal is sent to the Commission of Culture and Communication.
2023-01-03: Commission of Culture and Communication issues an Opinion on the implementation proposal. The Opinion deals only with formality requirements.
2023-01-23: Civil society sends open letter to Portuguese MPs asking them to not delegate to the government the drafting and discussion of the implementation law.
2023-01-25: Plenary discussion of the government delegation law proposal. Delegation law approved.
2023-03-27: Government publishes implementation proposal and opens public consultation.
2023-04-25: Deadline for submissions to the public consultation.
Civil society participates in the public consultation
