Welcome, and thank you for your interest in the Close the Gap Foundation, a California nonprofit public benefit corporation doing business as Close the Gap Foundation (“CTG”, “we,” or “us”) and our Web site at www.closethegapfoundation.org (the “Site”), networks, embeddable widgets, downloadable software, mobile applications (including tablet applications), and other services provided by us and on which a link to these Terms of Use is displayed (together with the Site, our “Service”). These Terms of Use are a legally binding contract between you and CTG regarding your use of the Service.
PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY. YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING THE CLOSE THE GAP FOUNDATION PRIVACY POLICY (TOGETHER, THESE “TERMS”). If you are not eligible or do not agree to these Terms, then you do not have our permission to use the Service.
1. Service Overview
Close The Gap Foundation is dedicated to bridging the gap to give every FGLI (First Generation and Low-Income) student a chance to reach their potential despite their socioeconomic upbringing.
2. Modification
We reserve the right, at our discretion, to change these Terms on a go-forward basis at any time. Please check these Terms periodically for changes.
3. Eligibility
You must be at least thirteen (13) years of age to use the Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least thirteen (13) years of age; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with all applicable laws and regulations. If you are using the Service on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that organization to these Terms, and you agree to be bound by these Terms on behalf of that organization. Please also be aware that in order to apply for CTG’s existing program, including microgrants and fellowships, students must meet each of the program’s separate eligibility requirements. CTG’s microgrant and fellowship programs are highly competitive, and CTG cannot guarantee that all eligible applicants will be accepted into that program.
4. Site Access
For such time as these Terms are in effect, we hereby grant you permission to visit and use the Site provided that you comply with these Terms and applicable law.
5. Accounts and Registration
In order to use some of the services of the Site, you may have to create an account ("Account"). You agree not to create an Account for anyone else or use the account of another without their permission. When creating your Account, you must provide accurate and complete information. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. You must notify CTG immediately of any breach of security or unauthorized use of your Account. As between you and CTG, you are solely responsible and liable for the activity that occurs in connection with your Account. If you wish to delete your Account, you may send an email request to CTG at [email protected].
6. Intellectual Property Rights
6.1. Content and Marks. The (i) content on the Site, including without limitation, the text, documents, articles, brochures, descriptions, products, software, graphics, photos, sounds, videos, interactive features, and services (collectively, the "Materials"), (ii) and User Submissions, as defined below (together with the Materials, the "Content"), and (iii) the trademarks, service marks and logos contained therein ("Marks"), are the property of CTG and/or its licensors and may be protected by applicable copyright or other intellectual property laws and treaties. “CTG”, the CTG logo, and other marks are Marks of CTG or its affiliates. All other trademarks, service marks, and logos used on the Site are the trademarks, service marks, or logos of their respective owners. We reserve all rights not expressly granted in and to the Site and the Content.
6.2. Use of Content. Content on the Site is provided to you for your information and personal use only and may not be used, modified, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, or otherwise exploited for any other purposes whatsoever without our prior written consent. If you download or print a copy of the Content, you must retain all copyright and other proprietary notices contained therein.
7. Restrictions
You shall not: (i) copy, distribute or modify any part of the Site without our prior written authorization; (ii) use, modify, create derivative works of, transfer (by sale, resale, license, sublicense, download, or otherwise), reproduce, distribute, display or disclose Content (defined below), except as expressly authorized herein; (iii) disrupt servers or networks connected to the Site; (iv) use or launch any automated system (including without limitation, "robots" and "spiders") to access the Site; and/or (v) circumvent, disable or otherwise interfere with security-related features of the Site or features that prevent or restrict use or copying of any Content or that enforce limitations on use of the Site.
