**Terms of Service for Greenlight**

## 1. Acceptance of Terms
By downloading, installing, or using Greenlight - Fertility Support (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Greenlight ("we," "our," or "us").
## 2. Description of Service
Greenlight is a fertility support application that provides:
- Discreet fertility window reminder notifications
- Partner synchronization through anonymous tokens
- Customizable code-word notifications
- Subscription-based premium features
**Important Medical Disclaimer**: Greenlight is NOT a medical device, does not provide medical advice, and should not be used as the sole method for fertility planning or contraception. Always consult with qualified healthcare professionals for medical advice.
## 3. Eligibility
You must be at least 17 years old to use this App. By using the App, you represent and warrant that:
- You are at least 17 years of age
- You have the legal capacity to enter into this agreement
- You are not prohibited from using the App under any applicable laws
## 4. Subscription Terms
### 4.1 Free Trial
- New users receive a 7-day free trial with full access to all features
- You may cancel anytime during the trial period without charge
- If you do not cancel before the trial ends, you will be automatically charged for your selected subscription plan
### 4.2 Subscription Plans
We offer three auto-renewable subscription options:
- **Monthly**: $4.99 per month
- **Quarterly**: $12.99 per 3 months
- **Annual**: $29.99 per year
### 4.3 Payment and Renewal
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- Renewals will be charged at the same price as your initial subscription
### 4.4 Cancellation
- You can cancel your subscription anytime through your Apple ID Account Settings
- Cancellation takes effect at the end of the current billing period
- You will continue to have access until the end of the paid period
- No refunds will be provided for partial subscription periods
### 4.5 Price Changes
- We reserve the right to change subscription prices
- Price changes will be communicated at least 30 days in advance
- Continuing to use the App after price changes take effect constitutes acceptance of new prices
## 5. User Accounts and Tokens
### 5.1 Pairing Tokens
- The App uses anonymous 6-character tokens for partner pairing
- You are responsible for sharing tokens only with your intended partner
- Tokens expire after 90 days of inactivity
- We are not responsible for unauthorized access due to token sharing
### 5.2 Account Security
- You are responsible for maintaining the confidentiality of your pairing token
- You agree to notify us immediately of any unauthorized use
- We are not liable for any loss arising from unauthorized use of your token
## 6. User Conduct
You agree NOT to:
- Use the App for any unlawful purpose or in violation of these Terms
- Share false or misleading fertility information with your partner
- Attempt to access other users' data or tokens
- Reverse engineer, decompile, or disassemble the App
- Use the App to harass, abuse, or harm others
- Circumvent subscription requirements or payment systems
- Use automated systems or bots to access the App
- Violate any applicable laws or regulations
## 7. Intellectual Property
### 7.1 Ownership
- The App and all its content, features, and functionality are owned by Greenlight
- The App is protected by copyright, trademark, and other intellectual property laws
- Our trademarks and trade dress may not be used without our prior written permission
### 7.2 User Content
- You retain ownership of any fertility data you input
- You grant us a limited license to use this data solely to provide the service
- We will delete your data according to our Privacy Policy
## 8. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to:
- Collection and use of information as described in our Privacy Policy
- Automatic deletion of data after 90 days
- Anonymous token-based partner sharing
## 9. Disclaimers
### 9.1 Medical Disclaimer
THE APP IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING FERTILITY OR MEDICAL CONDITIONS.
### 9.2 No Guarantees
We do not guarantee:
- Pregnancy or conception success
- Accuracy of fertility predictions
- Effectiveness as a contraception method
- Uninterrupted or error-free service
### 9.3 Service Availability
- The App is provided "as is" and "as available"
- We do not warrant uninterrupted or error-free operation
- We may modify or discontinue features without notice
- We are not liable for any service interruptions
## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the subscription in the past 12 months
- We are not liable for any pregnancy outcomes or fertility-related results
- We are not responsible for missed notifications or technical failures
## 11. Indemnification
You agree to indemnify, defend, and hold harmless Greenlight and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:
- Your violation of these Terms
- Your use or misuse of the App
- Your violation of any third-party rights
- Any content you submit or share through the App
## 12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date
- Sending an in-app notification
- Requiring acceptance for continued use
Your continued use of the App after changes constitutes acceptance of the modified Terms.
## 13. Termination
### 13.1 By You
You may terminate your use of the App at any time by:
- Canceling your subscription
- Deleting the App from your device
- Requesting deletion of your data
### 13.2 By Us
We may terminate or suspend your access immediately, without prior notice, if:
- You breach these Terms
- We are required to do so by law
- We discontinue the service
### 13.3 Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- We may delete your data according to our Privacy Policy
- Provisions that should survive termination will remain in effect
## 14. Governing Law and Disputes
### 14.1 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
### 14.2 Dispute Resolution
- You agree to first attempt to resolve disputes informally by contacting us
- If informal resolution fails, disputes will be resolved through binding arbitration
- Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
- You waive the right to participate in class actions or class arbitrations
### 14.3 Exceptions
You may bring claims in small claims court if they qualify. Either party may seek injunctive relief for intellectual property violations.
## 15. General Provisions
### 15.1 Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Greenlight.
### 15.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in full force.
### 15.3 Waiver
Our failure to enforce any provision shall not constitute a waiver of that provision.
### 15.4 Assignment
We may assign these Terms at any time. You may not assign your rights without our written consent.
### 15.5 Force Majeure
We are not liable for delays or failures due to causes beyond our reasonable control.
## 16. Apple-Specific Terms
If you access the App through an iOS device:
- Apple has no obligation to furnish maintenance or support services
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims relating to the App
- Apple is not responsible for third-party intellectual property claims
- Apple and its subsidiaries are third-party beneficiaries of these Terms
