By downloading or using the "ShakeFizz" application (hereinafter referred to as the "Service"), these terms will automatically apply to you. You should make sure therefore that you read them carefully before using the app. 本利用規約（以下、「本規約」）は、HIBIKI TAMAKI（以下、「当方」）が提供するモバイルアプリケーション「ShakeFizz」（以下、「本サービス」）のご利用条件を定めるものです。ユーザーの皆様は、本サービスをダウンロード、インストール、または利用することによって、本規約に同意したものとみなされます。

1. Description of Service / サービスの提供

The Service is a mobile game application. We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time without notice. 本サービスは、端末を振る回数や速度を競うゲームアプリケーションです。当方は、事前の通知なく、本サービスの機能、名称、提供方法を変更、または提供を一時停止・終了することができるものとします。

2. User Accounts and Data / アカウントおよびデータ

1. The Service uses automatic anonymous authentication. Your display name and scores are linked to this anonymous account. 本サービスでは、匿名認証により自動的にアカウントが作成されます。設定した表示名やゲームスコアは、このアカウントに紐づいて保存されます。
2. If you delete the app or change your device, we cannot guarantee the recovery of your data or scores. アプリのアンインストールや端末の変更を行った場合、従来のデータの引継ぎや復元は保証されません。
3. We reserve the right to delete accounts or scores that we deem inappropriate or obtained through fraudulent means. 不適切な表示名、または不正な手段（チート行為等）によって取得されたと当方が判断したスコアやデータは、事前の予告なく削除、またはランキングから除外する場合があります。

3. Acceptable Use / 禁止事項

When using the Service, you must not: ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。

• Use the Service in any way that violates any applicable laws or regulations. 法令または公序良俗に違反する行為。
• Use cheating, automation software (bots), hacks, mods, or any other unauthorized third-party software designed to modify the Service or manipulate scores. チート、ボット、ハッキングツールなどを利用し、意図的にゲームシステムを不正操作したり、スコアを改ざんする行為。
• Impersonate others or use offensive, abusive, or inappropriate display names. 他のユーザーになりすます行為、または他者を不快にさせる、誹謗中傷にあたる表示名を使用する行為。
• Reverse engineer, decompile, or attempt to extract the source code of the app. 本サービスのソースコードの改変、リバースエンジニアリング、逆アセンブル等を行う行為。

4. Limitation of Liability / 免責事項

1. The Service is provided "as is" and "as available". We make no warranties, either express or implied, about the Service. 本サービスは「現状有姿」で提供されるものとし、当方は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます）がないことを明示的にも黙示的にも保証しておりません。
2. PHYSICAL DAMAGE AND INJURY: The Service requires physical movement (shaking the device). You are solely responsible for ensuring you have a safe environment and a secure grip on your device. We are not liable for any personal injury, property damage (including dropping your phone), or other damages resulting from gameplay. 【身体的・物理的損害に関する免責】 本サービスは、端末を物理的に「振る（シェイクする）」動作を伴います。ユーザーは自身の周囲の安全を確保し、端末を落とさないようしっかりと保持する責任を負います。ゲームプレイ中の端末の落下による破損、周囲の人や物への衝突による損害、その他一切の身体的・物理的損害について、当方は一切の責任を負いません。
3. We are not liable for any data loss, including scores or settings, due to user actions or server issues. サーバーの障害、通信回線の不具合、またはユーザー自身の誤操作によるデータの消失等について、当方は一切の責任を負いません。
