1. ACCEPTANCE AND AGREEMENT

1.1 Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and Michael Spix, operating as a sole proprietorship under German law ("Company," "we," "us," or "our") regarding your access to and use of our MentorCircle AI mobile application and related services (collectively, the "Services"). By accessing, downloading, installing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.2 Age Requirements and Parental Consent

• Minimum Age: You must be at least 17 years old to use our Services
• Age Verification: By using the Services, you represent and warrant that you are 17 years of age or older
• Parental Supervision: Users under 18 are encouraged to use the Services under parental guidance

1.3 Entity Authorization

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

1.4 Terms Updates and Modifications

We reserve the right to modify these Terms at any time. Material changes will be effective 30 days after posting, except for changes addressing new functionality or legal requirements, which are effective immediately. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.

2. IMPORTANT DISCLAIMERS AND LIMITATIONS

2.1 AI Service Limitations

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• Artificial Intelligence Nature: MentorCircle AI utilizes artificial intelligence technology that generates responses based on patterns in training data
• No Human Mentorship: AI mentors are software programs and do not represent real human mentors or professionals
• Unpredictable Responses: AI-generated content may be unpredictable, inaccurate, inappropriate, or contextually irrelevant due to the emergent nature of AI systems
