How Our Services Work
✦ Monthly Subscription
Through a subscription model, Floxie Studio offers graphic design, web design, and development, as well as UI/UX design services. Clients can submit unlimited design requests**,** with one active request at a time, for a fixed recurring monthly fee.
A Request may include, for example:
- Creating a graphic based on the provided visual assets and text.
- Improving user experience for an application.
- Resizing an image to specific dimensions while maintaining proportions.
- Design an A5 Flyer for a social workshop
Requests must align with our scope of work and follow our submission guidelines. Some complex or custom web development projects may require additional discussions or a separate agreement beyond the standard subscription.
Revisions are limitless, and the average turnaround per request is 72 business hours. Nevertheless, certain complex requests may take a little longer. The client is aware of this and acts accordingly.
✦ Non‑Transferable, Single‑User Subscription
- Exclusive Use: Each subscription is issued to a single Client and may only be used for that Client’s projects, brands, or business entities as specified in the subscription agreement.
- No Shared Access: The subscription may not be used to submit requests on behalf of friends, colleagues, third-party businesses, affiliated entities, or any other person or organization. Each entity must maintain its own active subscription.
- Authorized Users: Access is restricted to individuals employed by or contractually engaged with the Client. Floxie Studio reserves the right to verify users and suspend access for any unverified or unauthorized individual.
- Affiliates & Subsidiaries: Work for affiliates, sub-brands, partner companies, or subsidiaries is not included unless explicitly approved in writing or covered by additional subscriptions or fees.
- Compliance & Enforcement: Any breach of this policy may result in paused or terminated service without refund. Floxie Studio reserves the right to seek payment for unauthorized work performed and to decline any request that falls outside the agreed subscription scope.
✦ Design Requests
- Required Information: Each request must include a clear description along with any necessary files, brand assets, copy, or materials (“User Content”) required to complete the design. Incomplete or unclear requests may be paused until sufficient information is provided.
- Ownership of User Content: The Client retains full ownership of all User Content and grants Floxie Studio a limited, non-exclusive license to use this content solely for the purpose of fulfilling the request.
- Portfolio & Archiving: Floxie Studio may archive and feature completed work for portfolio, marketing, or promotional purposes. Clients may opt out of public display by submitting a written request prior to the work being showcased.
✦ Delivery & Turnaround Time
- Standard Turnaround: Requests are typically delivered within an average of 72 business hours once all required information is submitted and approved.
- Complex Requests: Larger or more complex requests (such as multi-page documents, animations, branding systems, or advanced design concepts) may require additional time at Floxie Studio’s discretion. Any estimated extension will be communicated to the Client.
- Business Hours: Business hours are Monday through Friday, according to official working days in Portugal, excluding national holidays. Turnaround time is calculated only during these business hours.
- Delivery Format: Completed files will be delivered for review and download. Editable/source files, proprietary formats, or code are only provided if explicitly agreed in the Subscription Plan or a separate written agreement.
Legal Compliance
✦ Business Days, Holidays & Availability
- Operating Schedule: Floxie Studio operates Monday through Friday on official business days in Portugal. The studio is closed on Saturdays, Sundays, and non-working public holidays.
- Turnaround Calculation: All delivery timelines and turnaround estimates are calculated based on business days only. Any requests or revisions submitted outside of business hours, on weekends, or during national holidays will be considered received on the next business day.
- Observed Holidays: Floxie Studio observes official national holidays in Portugal. A list of observed holidays will be provided annually or upon request. No work is performed, and no turnaround time is counted on these dates.
- Advance Holiday Notice (Applicable to 6-Month+ Subscriptions):
- For subscriptions with a duration of six (6) months or longer, Floxie Studio will provide at least thirty (30) days’ notice of upcoming observed holidays or planned non-operational dates, including a rolling six-month calendar of closures.
- For subscriptions shorter than six (6) months, only the standard national holiday schedule applies, and no additional advance notice is required.
✦ Portugal Vacation Compliance
- Legal Entitlement: In accordance with Portuguese labor law, employees are entitled to a minimum of 22 working days of paid vacation per year, with at least 10 consecutive working days taken within this period. A minimum of 20 days must be used annually, and unused vacation days cannot be exchanged for monetary compensation except as expressly permitted by law.
- Operational Continuity: Floxie Studio proactively plans resources to ensure continued service during statutory vacation periods. While response times or delivery estimates may be adjusted during these periods, any material impact on active requests will be communicated in advance.
- Scheduling & Notice to Clients: If an employee vacation period is expected to affect ongoing work or deadlines, Floxie Studio will provide reasonable advance notice and coordinate revised timelines or request prioritization. Subscriptions with a term of six (6) months or longer may receive a scheduled vacation calendar as part of ongoing account management.
Intellectual Property & Usage
✦ Intellectual Property Rights
- Ownership Prior to Completion: All intellectual property rights in any designs, websites, UI/UX, or related creative work produced by Floxie Studio remain the exclusive property of Floxie Studio until the work is formally approved and all associated fees are fully paid.
- Transfer of Rights: Upon final approval and receipt of full payment, ownership of the final deliverables is transferred to the Client, excluding any third-party licensed elements (such as stock images, typefaces, plugins, or code frameworks), which remain subject to their respective licenses.
- License for Drafts & Non-Final Work: All draft concepts, preliminary designs, wireframes, prototypes, or unapproved versions remain the property of Floxie Studio and may not be used, reproduced, or distributed by the Client without explicit written permission.
- Moral Rights: Floxie Studio retains moral rights over all work created, including the right to be credited as the designer/creator and the right to object to any intentional distortion, modification, or derogatory treatment that may harm its professional reputation.
- Client Modifications: Any modification or use of the work beyond its agreed purpose is undertaken at the Client’s own risk. Floxie Studio bears no liability for performance, brand consistency, or legal compliance arising from such modifications.
- Portfolio & Promotional Use: Floxie Studio may display completed work for portfolio, marketing, and promotional purposes unless a written confidentiality or non-disclosure agreement is in place before the start of the project, explicitly opting out of such usage.
Service Limits & Termination
✦ Fair Use Policy
- Scope of Use: “Unlimited” Requests are provided for normal use consistent with the nature of Floxie Studio’s services. Excessive or unusually high volumes that go beyond reasonable industry standards may be subject to review.
- Monitoring & Enforcement: Floxie Studio reserves the right to limit, delay, or refuse Requests if usage is deemed excessive or abusive. Clients will be notified if such limits are applied.
- Third-Party Requests: Using a subscription to submit Requests on behalf of third parties, affiliates, or other entities not covered under the subscription is strictly prohibited and constitutes misuse.
- Suspension & Termination: Continued violation of the fair use policy, or repeated submission of excessive or unauthorized Requests despite warnings, may result in suspension or termination of the subscription without refund.
✦ Cancellation Policy
- Client-Initiated Cancellation: Clients may cancel their subscription at any time. Cancellation stops future recurring charges but does not entitle the Client to a refund for the current subscription period.
- Access During Active Period: Access to Floxie Studio services continues until the end of the current billing cycle, even after cancellation.
- Billing Cutoff & Effective Date: Cancellation becomes effective immediately upon confirmation. The current subscription period is considered fully active until its scheduled end date; no partial refunds are issued for unused days. Future billing stops from the next cycle onward.
- Non-Refundable Fees: All subscription fees are non-refundable, whether full or partial, including for unused services, requests, or time.
- How to Cancel: Clients can cancel their subscription by contacting Floxie Studio support at hello@floxie.studio. Confirmation of cancellation will be sent via email.
- Acknowledgment: By subscribing, the Client acknowledges and agrees to this cancellation policy, including the non-refundable nature of fees and billing cutoff terms.
Compliance & Claims
✦ Copyright Violation
- Prohibited Content: Clients may not submit content that infringes or violates the intellectual property rights of any third party. Submission of such content constitutes a breach of these Terms.
- Reporting Infringement: Copyright owners or authorized representatives may report alleged infringements by sending a written takedown request to hello@floxie.studio. The request should include sufficient information to identify the copyrighted work and the allegedly infringing material.
- Floxie Studio’s Response: Upon receipt of a valid takedown request, Floxie Studio will take appropriate action, which may include removing or disabling access to the infringing content and notifying the Client.
- Client Responsibility: Clients are solely responsible for the content they submit and for ensuring they have the necessary rights or licenses to use it.
Liability & Data
✦ Liability Limitation
Floxie Studio is not responsible for any of the following:
- Liability Cap: To the fullest extent permitted by law, Floxie Studio’s total liability is strictly limited to the amount paid by the Client for the subscription period in which the liability arose.
- Client Responsibility: Clients are responsible for ensuring that all use of delivered work complies with applicable laws, intellectual property rights, and other legal requirements.
✦ Data Protection & GDPR Compliance
- Commitment to Privacy: Floxie Studio protects Client personal data in full compliance with the General Data Protection Regulation (GDPR) and applicable EU laws.
- Data Collected:
- Purpose of Processing: Client data is used solely to:
- Client Rights: Clients have the right to access, correct, delete, restrict processing, or withdraw consent for their personal data at any time. Requests can be submitted to hello@floxie.studio.
- Data Security & Retention: Industry-standard technical and organizational measures are in place to protect personal data. Data is retained only as long as necessary to provide services, fulfill contractual or legal obligations, and ensure proper business operations.
