Tally – Privacy Policy & Terms of Use

1. Overview Tally ("we," "us," or "our") is a mobile application that helps groups scan receipts, split expenses, and coordinate payment requests. By downloading or using Tally, you agree to this policy in full. If you do not agree, do not use the app.

2. What Tally Is Not Tally is not a bank, payment processor, payment network, or financial institution of any kind. Tally does not transfer, hold, process, or touch money at any point. Tally solely constructs payment request links that open third-party payment applications already installed on your device. All payments are made exclusively between users through those independent third-party platforms. We have no affiliation with, endorsement from, or control over any third-party payment platform, including but not limited to Venmo, Cash App, and Zelle.

3. Acceptance of Terms By accessing or using Tally, you confirm that you are at least 13 years of age, that you have read and understood this policy, and that you agree to be bound by it. If you are using Tally on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

4. Use at Your Own Risk Tally is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the app will be error-free, uninterrupted, secure, or free of viruses or other harmful components. Your use of Tally is entirely at your own risk.

5. No Financial Advice Nothing in Tally constitutes financial, legal, accounting, or tax advice of any kind. Tally is a convenience and calculation tool only. You are solely responsible for verifying the accuracy of all expense calculations, splits, and payment amounts before initiating any payment through any third-party platform.

6. Limitation of Liability To the fullest extent permitted by applicable law, Tally and its founders, officers, employees, contractors, and affiliates shall not be liable for any damages whatsoever arising out of or related to your use of the app, including but not limited to:

• Loss of money or assets resulting from payment disputes between users
• Incorrect expense calculations relied upon by users
• Unauthorized access to your account
• Actions, errors, or outages of any third-party payment platform
• Loss of data, loss of profits, or business interruption
• Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind

In no event shall our total cumulative liability to you for any claims arising from your use of Tally exceed the total amount you have paid to use Tally in the twelve months preceding the claim. Because Tally is provided free of charge, that amount is zero dollars ($0.00).

7. Indemnification You agree to indemnify, defend, and hold harmless Tally and its founders, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the app, your violation of this policy, or your violation of any rights of a third party.
