These Swisstronik Ambassador Program Terms and Conditions (the “Agreement”) are a legal agreement between you (the “Creator”) and Sigma Assets GmbH, the developer of the Swisstronik Network, further refereed to as SWISSTRONIK that governs your participation in the Swisstronik Ambassador Program (the “Campaign”). The purpose of this Agreement is to outline the terms and conditions under which you will be compensated based on the performance you produce on the Swisstronik Discord Points (SDP) leaderboard.

Please review the information below carefully before agreeing to participate in the Campaign, disclosing your intention or actual participation in the Campaign, accessing or using any Campaign Material, as defined below, or broadcasting or publicizing any Posts, as defined below, so that you are aware of your legal rights and obligations to SWISSTRONIK and any of our affiliates, parents, partners, licensors, and subsidiaries (individually and collectively, “SWISSTRONIK”, “Company” “we,” “us,” or “our”).

By submitting your application, you agree to the terms and conditions set forth herein.

Term

This Agreement is effective from the date you’ve agreed to, accepted, or otherwise executed this Agreement and terminates 12 months from such date or May 06, 2024, whichever is sooner (“Term”).

Social Media Posts

During the Term, you agree to publish several social media posts (“Posts”) on the specific social media platforms identified in Exhibit A. The posts will conform to the specifications and instructions outlined in Exhibit A. We will provide you with the necessary briefing materials so you can create Posts that achieve the goals of the Campaign (the “Campaign Materials”). All Posts will meet the following requirements:

• Although we want your Posts to be authentic, your Posts should only include factual statements about SWISSTRONIK and our products that you know for certain are true, and SWISSTRONIK can prove or verify. Your Posts should also rely on the Campaign Materials to accurately use our trademarks, describe the Campaign, and describe our products.
• Your Posts will reflect your own honest opinions, beliefs, and experiences.
• Your Posts will be original and created solely by you.
• Your Posts will not include the intellectual property of other parties, including any third-party music, photographs, artwork, trademarks, logos, or slogans.
• Your Posts will not include any person, or personally identifiable information about anyone, other than you unless you receive our prior written approval and have the persons at issue sign a release provided by us.
• Your Posts will comply with the rules of the applicable social media platforms.
• Your Posts will comply with our standards of conduct set out in Exhibit B and any other policies we provide you.
• Your Posts will comply with all applicable laws, rules, and regulations.
