1.1 These General Terms and Conditions (hereinafter "GTC") of Thomas Neumann, acting under the name "Thomas Neumann" (hereinafter "Seller"), apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding the goods presented by the Seller on the internet trading platform itch.io. 1.2 For contracts regarding the provision of digital content, these GTC apply accordingly, unless otherwise regulated. Digital content is defined as data created and provided in digital form.
2.1 By listing an item on itch.io, the Seller makes a binding offer to sell this item. 2.2 The Customer accepts the offer via the online order form provided by itch.io. By clicking the button that concludes the ordering process, a binding purchase contract is established. 2.3 The contract text is stored by the Seller and sent to the Customer in text form (e.g., email) after the conclusion of the contract.
3.1 Consumers generally have a right of withdrawal. 3.2 Detailed information can be found in the Seller's "Right of Withdrawal" policy (Section 3).
4.1 Prices shown are total prices. As a small business owner (Kleinunternehmer), the Seller is exempt from VAT according to German law (ยง 19 UStG). 4.2 For deliveries outside the EU, additional costs such as customs duties or exchange fees may apply, which the Customer shall bear. 4.3 Payment is processed via the payment providers designated by itch.io. Further information can be found in the itch.io Terms of Service.
5.1 Digital content is provided exclusively via download.
6.1 Unless otherwise stated in the product description, the Seller grants the Customer a non-exclusive right, unlimited in time and place, to use the content exclusively for private purposes. 6.2 Any transfer of content to third parties or the creation of copies for third parties outside the scope of these GTC is prohibited without express consent. 6.3 Rights are only granted upon full payment of the agreed remuneration.
