Equipment Lease/Rental Agreement

These terms and conditions form part of the rental contract (the "Rental Contract") between you and Calvin University’s Communication Department’s Equipment Room and apply to all the equipment and/or accessories (the "Equipment") rented by you. These terms and conditions constitute additional provisions of and guide the interpretation of the Rental Contract. In the event of a conflict between these terms and conditions hereof and the Rental Contract, the terms of the Rental Contract shall prevail.

Pre-Production - Testing the Equipment

  1. It is encouraged that you test the equipment and/or miscellaneous accessories before leaving the equipment room with it. You will always have an opportunity to test and examine the equipment to determine whether it is in good working order. You may test the equipment in the “Equipment Room” or adjacent “Control Room” prior to checking it out.
  2. You are considered to have taken delivery of the equipment and, therefore, assume all risk of loss from the time you begin testing the equipment or leave the equipment without testing the equipment. You are responsible for any damage you cause to equipment, property, or person(s) during testing. After completing your tests, you must notify the Equipment Room staff or the Production Manager of the department of any defective or inoperable equipment immediately upon discovering the defect. Unless you inform the Equipment Room staff or the Production Manager of a defect or problem with the equipment supplied, you agree that the equipment is in good working order and that the equipment is acceptable to you.

Transporting Equipment - Pick Up & Delivery

  1. All equipment should be picked up and returned to the Equipment Room during business hours. If you do not pick up and/or return the equipment to the Equipment Room, you may use the return locker adjacent to the Equipment Room (Return Locker Agreement). Regardless of your choice, you are ultimately responsible for ensuring all equipment is safely returned to the Equipment Room.

Your Responsibilities With Regard to the Equipment

  1. YOU ASSUME ALL RISKS OF LOSS UP TO CALVIN UNIVERSITY’S INSURANCE DEDUCTIBLE. Once you have taken delivery of the equipment, your responsibility includes but is not limited to risks while in transit, at all locations named and unnamed, at all studios, while on your own premises, and while in use or storage on our facility's premises. Except for natural wear and tear, acts of God, and/or other unforeseeable circumstances.
  2. YOUR RESPONSIBILITY ENDS WHEN THE EQUIPMENT IS RETURNED AND CHECKED BACK INTO THE EQUIPMENT ROOM. Equipment will not be deemed to have been returned until all of the following conditions have been met: 1) Equipment has been brought back to the Equipment Room during regular business hours (or secured in the return locker outlined in the Return Locker Agreement agreement); and 2) An inventory has been completed, and a missing and damaged list has been compiled if needed.

Restrictions Upon the use of the Equipment

  1. Unless otherwise agreed, all equipment is for local use only. ****Geographic restrictions can be removed from the Rental Agreement by mutual agreement between you and the Production Manager.
  2. All equipment is to be used by qualified students only**.** The Equipment may be used only by duly qualified students and/or agents and strictly per the use contemplated in the Rental Agreement. If a student is not qualified to operate a particular piece of equipment at the time of checkout, the student will need to receive the appropriate certification from the Equipment Room staff or the Production Manager prior to checking out the equipment in question. You shall keep the equipment in your sole custody and shall not permit the equipment to be used in violation of any laws. NO SUBLEASE BY YOU IS PERMITTED. You may not sublease all or any part of the equipment without written consent of the Production Manager.
  3. DO NOT REMOVE SERIAL NUMBERS OR COVER COMPANY LOGOS. You may not remove or cover over any serial numbers, tags, nameplates, or identifying logos on the equipment showing ownership by Calvin University’s Communication Department.
  4. No warranty or guarantee exists except as the law provides. Equipment is rented to you without warranty or guarantee of any kind, expressed or implied, and Calvin University’s Communication Department assumes no responsibility unless agreed to in writing.

Equipment Damaged or Destroyed While in the Field

  1. As soon as you discover that equipment in the field is defective, you should notify the Equipment Room staff of the problem (through the “Damaged Gear Form” at the following URL calvin.edu/go/equipmentroom) and, if necessary, return the equipment to the Equipment Room, for evaluation. The Equipment Room staff and/or the Production Manager will make a reasonable effort to repair or replace the equipment in the shortest amount of time.
  2. In the event of loss and damages the Equipment Room staff and/or the Production Manager will make a determination of the extent of the damage and the required repairs. You and/or your representative(s) will have a reasonable amount of time to inspect the damage. In determining whether equipment shall be replaced or repaired, the Production Manager’s judgment shall be conclusive upon you. Should the Production Manager determine that the equipment must be replaced and the loss of the equipment was due to foreseeable and/or negligent actions taken on behalf of the lessee, you will be responsible for the cost to replace the same item or the closest comparably equipped model, up to Calvin University’s insurance deductible.
  3. If after delivery to you, any of the equipment is lost, stolen, damaged beyond repair, destroyed, or otherwise disappears or is not returned for any foreseeable and/or negligent reason, you will be responsible for the cost to replace the same item or the closest comparably equipped model, up to Calvin University’s insurance deductible.
