These Terms of Use (“Terms”) govern your access to and use of the www.koodos.com website (the “Website”) and the Koodos mobile applications and Services, including, without limitation, any online and mobile websites, social networks and applications operated by or on behalf of Koodos and/or its affiliates that post, and are authorized to post, a link to these Terms (collectively, the “Services”). You agree that by visiting the Services or by registering or using the Services, you are entering a legally binding agreement with Koodos, Inc., (“Koodos”) based on the Terms and the Privacy Policy, which is hereby incorporated by reference (collectively referred to as the “Agreement”). Your access to and use of the Services are conditioned on your acceptance of and compliance with the Agreement. By accessing or using the Services you agree to be bound by the Agreement.

1. Basic Terms

Koodos provides a platform to allow you to curate online content provided by unaffiliated third-parties and offer commentary and view other users’ curations. Please be aware that by using Koodos, you may be exposed to content that contains words or images that you find mature, crude, vulgar or otherwise inappropriate. Koodos is making no representation that the selections you hear or see will be appropriate for your consumption. Koodos is not responsible and is making no endorsements or representations for any content provided by a third-party or any Koodos user.

You are responsible for your use of the Services, including the transmission, posting and uploading of information, and for any consequences thereof. You may only use the Services for lawful purposes and the Services are available only for your personal, non-commercial use. You may use the Services only if you can form a binding contract with Koodos and are not a person barred from accessing the Services under the laws of the United States or other applicable jurisdiction. If you are under 18 years of age you may only access or use the Services under the direct guidance and supervision of a parent or guardian who has accepted the Agreement on your behalf. If you are under 13 years of age you may not use the Services for any reason. Please contact us if you are aware that a person under 13 is using the Services. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.

By joining koodos, you agree that harassment, hate speech, and cyberbullying is not tolerated and that koodos exists to appreciate culture, ideas, and community.

The Services are always evolving and the form and nature of the Services may change from time to time without prior notice to you. In addition, Koodos may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.

2. Mobile Texting Terms

• By participating in the Koodos mobile text program and signing up for mobile text updates, you consent to receive future recurring text messages to the mobile number provided from or on behalf of Koodos.
• Message and data rates may apply. All charges are billed by and payable to your mobile service provider. Koodos does not charge you for sending or receiving text messages to our short code number.
• If you would like to be removed from the Koodos mobile text program, you must text stop to our short code number (u.s.) to opt-out. this is the exclusive method for opting out. after texting stop to our short code number you will receive one additional message confirming that your request has been processed.
• Koodos reserves the right to remove subscribers from our messaging database at our discretion. for more information, reply “help” to our short code number (u.s.) or contact us at [email protected].
• In the event that you change or deactivate your mobile number it is your responsibility to notify koodos at [email protected] to have your number removed.
• Koodos will not be liable for any delays in the receipt of any sms messages or undelivered messages. t-mobile policies require that we specify that t-mobile, also, will not be liable for any delays in the receipt of any sms messages or undelivered messages.
• Data obtained from you in connection with this sms service may include your cell phone number, your carrier's name, the date, time and content of your messages and other information you provide to us as part of this service. we may use this information to contact you and to provide the services you request from us.

3. Privacy

Any information that you provide to Koodos is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by Koodos. As part of providing you the Services, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your Koodos account, which you may not be able to opt-out from receiving. We do not track you using cookies or any other device tracking technology.

We engage service providers to perform functions and provide services to us. We may share your private personal information with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. This might include internal analytics purposes.
