General Terms and Conditions – Meijer & Münninghoff Real Estate
Article 1 – Applicability
These general terms and conditions apply to all agreements between a private client and Meijer & Münninghoff Real Estate (hereinafter: “the Agent”) concerning services related to property rental, property purchase, property letting or property sale.
Article 2 – Definitions
- Client: a natural person (consumer) not acting in a professional or business capacity.
- Agent: Meijer & Münninghoff Real Estate.
- Assignment: the agreement by which the Agent provides services to the Client, including but not limited to rental search, home purchase assistance, property sale or letting.
- Fee: the agreed compensation (commission) for services rendered, including any additional costs.
Article 3 – The Assignment
- The assignment shall be confirmed in writing and include:
- A clear description of the agreed services
- The applicable fee or commission
- Any additional or third-party costs
- All amounts include VAT unless otherwise stated.
- The agreement is effective once confirmed in writing by the Client.
Article 4 – Cooling-Off Period
- If the agreement is concluded outside the Agent’s office, the Client has a statutory right of withdrawal for 14 days.
- If the Client withdraws within that period, no fees are owed unless services have already commenced at the Client’s request.
Article 5 – Duties of the Agent
- The Agent shall perform the assignment with due care and expertise, representing the interests of the Client.
- The Agent will provide regular updates on progress.
- The Agent will not act for both parties (e.g. landlord and tenant, or buyer and seller) without prior written consent.
- The Agent will process personal data in compliance with GDPR.
