Article 1 (Purpose)

These terms and conditions are intended to stipulate the rights and obligations of the rental contract of the electric moped for rental between the lessor and the lessee.

Article 2 (Definition)

  1. The definitions of terms used in this agreement are as follows.

  3. “Electric moped for rental” (hereinafter “electric moped”) refers to a means of transportation provided by a company that has two or more wheels with a drive, steering, and brake system, and drives electricity. Hereinafter, unless specifically stated in these terms and conditions, “motorized mopeds for rental” and “terminals” are collectively referred to as “motorized mopeds”.

  4. The term “lease contract” refers to a member leases an electric moped from the company and the company leases an electric moped to a member according to the terms and conditions.

  5. “Terminal” refers to a device attached to the electric moped that performs functions such as tracking the location of the electric moped, Bluetooth communication with the member's mobile phone, IoT communication with the company's server, and detecting the shock of the electric moped, and Means apparatus.

  6. “MOBIGO” (hereinafter referred to as “service”) is a service that provides “motorized moped sharing” through an application (hereinafter referred to as “app”), and the details are in accordance with Article 3.

  7. The meaning of terms in the terms and conditions not defined in this section follows the company's terms and policies or general trading practices.

Article 5 (qualification for use of electric moped)

  1. Electric mopeds are rented only to members who meet all of the following items.

  1. In accordance with Articles 3 and 4 of these Terms and Conditions, the Company accepts the Member's Terms of Service and the application for use of these Terms and Conditions and applies for rental with the registered mobile phone number.

  2. A valid driver's license to drive a motorized bicycle (Class 1 large license, class 1 normal license, class 1 small license, class 2 normal license, class 2 small license, and class 2 motorized bicycle license) Means, but excludes a practice driver's license; hereinafter referred to as a “driver's license”).

  3. Members who have confirmed that they are familiar with the instructions for operating the electric moped (how to use, pop-up notice, etc.) through the verification procedure established by the company in “MOBIGO”

  4. Members who have confirmed that they have read the compliance requirements guideline (pop-up notice, etc.) when operating the electric moped through the verification procedure established by the company in “MOBIGO”

  5. Members who have checked the compliance requirements and instructions for operating electric mopeds regularly posted by the company through the verification procedure established by the company in “MOBIGO”

  1. Members must check the validity of their driver's license, such as acquisition, renewal, suspension, or cancellation of their driver's license. There is.

  2. Members shall check whether they are in a state of being drunk or in a state of fear that they may not be able to operate the motorized moped normally due to overwork, disease, or the influence of drugs, and other reasons. All responsibility arising from driving lies with the member.

  3. It is forbidden to use the information of registered members by a third party, and it is also prohibited to use the service by an unspecified third party other than the member. All responsibility arising from this lies with members and third parties who used the service.

Article 6 (Moped information collection device)

  1. The "Company" has installed a "location information collection device" on all electric mopeds for efficient service operation, and the purpose is as follows.

  1. “Operation information collection device” refers to the transmission of the operation information of the electric moped to the server of the “Company” such as the unmanned rental and return function of the electric moped, the location, the total accumulated mileage, the usage time, and theft and damage prevention. It refers to a communication terminal that can be used.

  2. Data collected through the "operation information collection device" can be used for asset management and protection of business operators, rental and return of electric mopeds, mileage check, usage time and fee check.

  3. The "Company" refers to a legal investigation request or order from an investigative agency, etc., for the collection of motorized mopeds in the event of a breach of contract, such as non-return of the motorized mopeds by the "member", fulfillment of the motorized moped lease contract, or dispute In the case of cooperation and implementation, if the "member" separately agrees to collect, use, and provide location information, the electric moped's location information may be collected, used, and provided within the scope of the above purpose.

  4. The information collected through the operation information collection device is managed and protected by the electric moped, checks for rental and return, voluntary collection, charges for use of the member, complaints from members or others regarding the electric moped, response to disputes, and electric mopeds. It can be used to cooperate with and fulfill government agencies and local governments investigations, orders, requests, etc. related to Fed, and to respond to fines, towing charges, fines, and criminal penalties of government agencies, local governments or courts related to electric mopeds.

  5. In accordance with “Article 15 of the Act on the Protection and Use of Location Information”, personal location information may be provided to emergency rescue organizations without the consent of the “member” if there is an emergency rescue request from an urgent risk.

Article 7 (concluding service)

  1. The conclusion of the service is completed when the member agrees to these terms and conditions (motorized moped rental terms).

  2. The "member" who wants to use the service can check the location of the electric moped that can be rented, the service charge, and the amount of battery in the "company" application in advance.

  3. The contents of the service can be used for the purpose of expressing opinions of the competent authority in the event of an accident or a fine.

  4. The "Company" may refuse to sign the service if the "member" falls under any of the following subparagraphs.

  1. If the "member" is unlicensed or the status of the driver's license is suspended, canceled, or there is a defect in information

  2. In case of failure to comply with questions and data requests of the "Company" or where identification is impossible

  3. When it is judged that the "member" is in a drinking state or is addicted to drugs such as drugs, stimulants, thinners, etc.

  4. When the "member" who signed the rental contract and the person operating the electric moped are different

  5. When there is non-payment of fees, etc. in relation to the past “company”

  6. When refusing to wear equipment such as helmets for safety

  7. When it is determined that the operation of the electric moped is impossible or unsafe by the member

  8. When the company determines that the driving of the member's electric moped is unsafe

  9. When there is an objective reason to refuse the conclusion of the rental contract as matters corresponding to each of the above items
