🤓 Labor Law

Danish employees are covered by different sets of rules depending on in which area the given person is employed. Most Danish employees in the private sector are either covered by the Danish Salaried Employees Act or by a relevant collective agreement.

• According to the Danish Salaried Employees Act, the employer is not entitled to dismiss employees employed for more than one year without a justified reason. In the given situation with Covid-19, the requirement of such a justified reason may be met, and the employer may dismiss employees with the applicable notice according to the Danish Salaried Employees Act and/or the employment contract.
• If the employee is covered by a collective agreement, the given collective agreement applies.
• According to Danish Holiday Act the employer is entitled to notify the employees’ holiday with a given notice. In this unusual situation with Covid-19, the employer may have the possibility to notify the employees’ holiday without notice.
• According to a recent agreement entered into between the government and relevant organisations, employers get an extended right to a refund for employees’ sick leave from day one (instead of after 30 days), if the given employee is on sick leave due to Covid-19. This agreement is applicable from 27 February 2020 until 1 January 2021.

💰 Financial compensation programmes

The Danish government has initiated several financial compensation programmes covering companies and employees suffering significant losses related to Covid-19 and the government’s restrictions as a consequence of Covid-19. In the section below, the main points of the most relevant compensation programmes are highlighted.

Compensation for employment salaries

• Companies, who intends to dismiss at least 30 % of the employees or more than 50 employees in total, are eligible to apply for partly compensation for the given salaries. It is a requirement that the company pay the employees’ full salary, that the given employees do not perform any work and that the company does not dismiss any employees in the compensation period.
• The government will compensate up to 75 % of the salary for permanent employees, however not more than DKK 23,000 per month per employee and up to 90 % of the salary for employees paid by the hour, however not more than DKK 26,000 per month per employee.
• Any employee covered by this compensation programme must use at least five days of holiday or time off during the compensation period.
