Another Dance Marathon program in the US has trademarked the terms "FTK" and "For The Kids". Due to this, no one is allowed to use these terms in any way (with few exceptions). These restrictions went into effect in May 2021.

In a nutshell, nothing public can use the terms any longer. If your program purchased any t-shirts or other apparel prior to May 2021, those can be sold, however nothing after May 2021 can be purchased with those terms. Any branded materials, like signs, banners, posters, etc., cannot be used by your program any longer. The following are ways you can no longer use these terms (list non-exhaustive):

• No public posts, stories, hashtags, bios, videos etc., can use those terms, unless For The Kids is used naturally in a sentence (i.e. "The hospital provides treatment for the kids" is okay, while saying "We are For The Kids" is not allowed). Old pictures posted with the terms (including on apparel) is discouraged. Beginning May 2021, BuckeyeThon will not repost anything that uses the terms in any manner, including old pictures.
• Any apparel purchased after May 2021 may no longer use the terms in anyway
• Any branded material (i.e. flyers, signs, banners, posters) may not use terms. Any old branded material can no longer be used
• Speeches must refrain from any usage of the terms. Using "for the kids" in a sentence (similar to the social media exception) is allowed, but usage as a slogan, call to action, etc., is not allowed.
• Any emails, letters, presentations, or other forms of communication may not use the terms in anyway

When in doubt, we encourage you to reach out to your YPC or the Director of Youth Philanthropy at [email protected] to clarify anything before usage. Any use of the terms will result in action from BuckeyeThon and may affect your programs status as a YP Program. BuckeyeThon and Ohio State are not responsible for any legal action, penalties, etc., that may result from the continued use of these terms.
