IN THE HIGH COURT OF JUSTICE

KING’S BENCH DIVISION

Case No: AC-2025-LON-001909

Title: The King (on the application of Malik) v Berkshire Magistrates’ Court and Others Court: High Court of Justice – King’s Bench Division
Deponent: Waseem Malik
Date: 23/07/2025

I, Waseem Malik, of 2 Vaughan Gardens, Eton Wick [SL4 6JT], being the Applicant in this matter, MAKE OATH and say as follows:

  1. I am the Applicant in these proceedings, and I make this affidavit in support of my N600 Contempt Application under CPR Part 81.
  2. On 30 June 2025, the High Court issued a certified order (📎 Log #489) compelling Thames Valley Police (TVP) to return personal property seized on 15 April 2025 (📎 Log #25). A penal notice was attached.
  3. On 02 July 2025, I attended Slough Police Station to collect the property. On-duty officers refused compliance and cited “lack of instruction” (📎 Log #484).
  4. On 04 July 2025, TVP Legal Services issued written confirmation that they would not comply with the order, citing procedural concerns — without seeking lawful suspension, variation, or judicial clarification (📎 Log #491).
  5. The order was clear, unambiguous, and included a penal notice. It was served properly and acknowledged. No lawful excuse has been advanced for its breach.
  6. The defiance is ongoing and deliberate. It constitutes contempt under CPR 81.4 and undermines the enforcement authority of the Court.
  7. I respectfully request that the Court make a finding of contempt and issue directions for penalty proceedings. This is supported by attached documents:

Statement of Truth: I believe the facts stated in this affidavit are true to the best of my knowledge and lawful understanding.
