Movant Eduardo A. Fernandez was convicted in Jefferson Circuit Court (case 09-CR-000749-001) of first-degree trafficking in cocaine (KRS 218A.1412). Sentenced 9/8/2011 to 5 years prison fully suspended + 5 years supervised probation. He filed to vacate and expunge in December 2022. DENIED on March 15, 2023. He did not get the felony erased from his record. This is now Exhibit H and is woven into Para 10 (intro) and Para 47 (suitability) of the Response.
