1. Acceptance of Terms By downloading, installing, accessing, or using the 2% Club mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App.
2. Description of the App 2% Club is an iOS application that offers curated content, interactive mapping features, community insights, and related services aimed at helping members understand and connect with the top two percent of financial performers (“Services”). We may add, change, or remove features at any time.
3. Eligibility You must be at least 18 years old and capable of forming a binding contract to use the App. By using the App, you affirm that you meet these requirements and that all account information you provide is accurate and complete.
4. Account Registration and Security You may be required to create an account to access certain features. Keep your login credentials confidential and notify us immediately of any unauthorized use. You are responsible for all activities under your account.
5. Subscriptions, Payments, and Refunds If the App offers paid subscriptions or in-app purchases, fees will be disclosed before you complete the transaction. Payments are processed through Apple’s App Store in accordance with its terms. Except where required by law, all purchases are final and non-refundable. We may change prices or introduce new fees with notice.
6. Use of the Services You agree to use the App only for lawful purposes and in accordance with these Terms, Apple’s App Store rules, and applicable laws. We grant you a personal, limited, non-transferable, non-exclusive license to use the App for your own use. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App except as permitted by law.
7. User Content and Conduct You may be able to submit content, including comments, map pins, or other materials (“User Content”). You retain ownership of your User Content but grant us a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform it in connection with the App. You agree not to submit User Content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable, and not to harass, impersonate others, or engage in harmful or fraudulent activity. We may remove or disable access to any User Content at our discretion.
8. Location Features The App may use location data to provide interactive maps and localized insights. You consent to our collection and use of location data as described in our Privacy Policy. Accuracy of location data is not guaranteed; use location- based features at your own risk.
9. Third-Party Services and Links The App may display links or integrate with third-party services. We do not control and are not responsible for third-party content or actions. Your use of third-party services is subject to their terms and policies.
10. Privacy Our collection and use of personal information is described in our Privacy Policy. By using the App, you consent to our data practices.
11. Intellectual Property The App, including all content, features, and functionality, is owned by 2% Club or its licensors and protected by intellectual property laws. All trademarks, service marks, and logos remain the property of their respective owners.
12. Disclaimer of Warranties The App and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that results or information obtained through the App will be accurate or reliable. You use the App at your own risk.
13. Limitation of Liability To the maximum extent permitted by law, 2% Club and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities arising from your use of or inability to use the App. Our total liability for any claim will not exceed the amount you paid, if any, for the App during the twelve months preceding the claim.
14. Indemnification You agree to indemnify, defend, and hold harmless 2% Club, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms or applicable law.
15. Termination We may suspend or terminate your account or access to the App at any time for any reason, including if we believe you violated these Terms. Upon termination, your right to use the App ceases immediately, and Sections that by their nature should survive termination will remain in effect.
16. Updates to These Terms We may update these Terms from time to time. If we make material changes, we will provide notice (such as updating the “Last updated” date or sending a notice through the App). Your continued use after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. You agree to submit to the personal jurisdiction of the state and federal courts located in San Francisco County, California, for any disputes arising from these Terms or the App.
18. Dispute Resolution Before filing a formal claim, you agree to contact us to resolve the dispute informally. If no resolution is reached, any dispute will be resolved through trial or to participate in a class action, except where prohibited by law. Notwithstanding the foregoing, either party may seek injunctive relief in court for intellectual property or unauthorized use claims.
